Antioch Councilwoman Charged With Misdemeanor After Interfering with Police Officer

On Tuesday, the Antioch Police Department filed misdemeanor charges on Antioch City Councilwoman Tamisha Torres-Walker with the Contra Costa County District Attorney’s Office. The charges stem from her role in a shooting incident in front of her home where she reportedly was interfering with a police investigation.
Walker has been charged with One Count of Resist, Obstruct, Delay of a Peace Officer or EMT. The case was filed Tuesday and no court date has been set.
A public records request for the body camera footage has been requested after the incident, still has not been provided since the case was under investigation.
According to the complaint:
COUNT 1 – RESIST, OBSTRUCT, DELAY OF PEACE OFFICER OR EMT
The undersigned states, on information and belief, that Tamisha Torres Walker, Defendant, did commit a Misdemeanor, a violation of PC148(a)(1), Resist, Obstruct, Delay Of Peace Officer Or EMT, committed as follows:
On or about October 3, 2021, in the County of Contra Costa, State of California, the crime of Resist, Obstruct, Delay Of Peace Officer Or EMT in violation of PC148(a)(1), a Misdemeanor, was committed in that TAMISHA TORRES WALKER did willfully and unlawfully resist, delay and obstruct Officer Desiderio who was then and there a peace officer attempting to and discharging the duty of his/her office and employment.
Complainant requests that the Defendant[s] be dealt with according to the law. I declare under penalty of perjury that the foregoing is true and correct.

Incident Background:
The incident occurred on October 3 when police responded to a noise complaint followed by several gunshots being fired in front of her home.
The incident occurred at approximately 12:30 am Saturday on Gary Avenue where police received a report of a large party, noise complaints and shots fired. Police confirmed around the same time as the call from a neighbor, shot spotter picked up 7 rounds fired. Upon arrival, 7 shell casings were located in front of her home—no injuries were reported.
Police said they were met by what appeared to be an intoxicated homeowner (Torres-Walker) who refused to cooperate while stating “Antioch Police could not be trusted”.
At 1:35 am, police received a second call stating the person responsible for the earlier shooting returned and went inside the home. Police were unable to make contact to investigate the shooting.
It was stated at the time, Walker also interfered with the investigating officers including grabbing an ID/paperwork from an Officer.
The incident prompted Antioch Mayor Lamar Thorpe to issue a statement requesting Torres-Walker step down as chair of the Antioch Police Oversight Committee. Mayor Pro Tem Monica Wilson also called for Torres-Walker to step down. Councilwoman Lori Ogorchock requested Torres-Walker resign from the committee itself. Meanwhile, Councilmember Mike Barbanica requested Torres-Walker step down from the Antioch City Council.
Walker ultimately stepped down as chair of the committee, however, she still remains a seated member.
History with Antioch Police
The Oct. 3 incident is not Walkers only incident with Antioch Police. After a Dec. 30, 2020 incident involving her sons, Walker took to social media and performed a 9-minute Facebook Live rant attacking the Antioch Police Department making several accusations. This prompted Walker to call for an investigation. Within the investigation report, Walkers claims were deemed false according to the report.
According to a public records request, the Antioch Police Department has responded to Torres-Walkers home in Antioch a total of 9 times between March 20, 2021 and October 3, 2021.

Antioch mayor asks city councilwoman to step down from police oversight committee
Mayor Lamar Thorpe says Tamisha Torres-Walker should step down as chair of the Antioch police oversight committee.
ANTIOCH, Calif. - The Contra Costa County District Attorney's Office on Tuesday charged Antioch City Councilmember Tamisha Torres-Walker with interfering with law enforcement when they were called to her home on a report of shots fired last month.
It was a surprise to Torres-Walker. When interviewed Wednesday, said it was the first she had heard of the charge. "No one contacted me," she said.
A police report on the Oct. 3 incident said neighbor calls and the city's gunshot detection system had indicated shots fired at a large party at Torres-Walker's home. Police reported finding seven shell casings at the scene.
The council member said Wednesday, "It's news to me. It's not surprising. This Police Department has been harassing me since I was sworn into office."
She denied that anyone fired any shots at her home on Oct. 3 or that any shell casings were found on her property.
"It's another attack on me and my family. Shots are fired almost every night in that neighborhood," she said.
Torres-Walker, a community organizer, has reported she was arrested 22 times, all for minor offenses, by the age of 18. In 2009 she was convicted for setting fire to an apartment building, and managed to enter a rehab program for alcohol after spending a year in county jail.
No one at the Police Department was immediately available for comment Wednesday.
